Welcome to CommunalBridgeWay ("we," "our," or "us"). These Terms & Conditions ("Terms") govern your use of our yacht charter services and website located at communalbridgeway.sbs (the "Service") operated by CommunalBridgeWay.

By booking a charter or accessing our Service, you agree to be bound by these Terms. If you disagree with any part of these terms, then you may not access the Service.

2. Service Overview

CommunalBridgeWay offers luxury yacht charter services that include, among others:

  • Daily yacht rentals
  • Sunset cruises
  • Corporate retreats
  • Private events
  • Multi-day charters

All our services are dependent on availability and are influenced by weather conditions. We retain the right to change or cease services as we see fit.

3. Booking and Reservations

3.1 Booking Process

To reserve a yacht, you must:

  • Be at least 18 years old
  • Provide valid and complete details
  • Make the required deposit payment as outlined in your reservation confirmation
  • Accept these Terms & Conditions

3.2 Confirmation

Your reservation is only confirmed upon our receipt of the payment and issuing a written confirmation. We maintain the right to decline services to any individual at our sole judgment.

3.3 Availability

All yacht charters are subject to the availability of the vessels and favorable weather conditions. We will make the necessary efforts to meet your requested dates and times for the charter.

4. Payment Terms

4.1 Pricing

All stated rates are in € and include taxes, unless noted otherwise. Prices are subject to alterations without prior notification.

4.2 Payment Schedule

  • Deposit: 50% of the overall charter cost is required at the time of booking
  • Balance: To be paid 48 hours prior to the charter departure
  • Extra fees (if applicable): To be paid after the completion of the charter

4.3 Payment Methods

We accept most major credit cards, bank wire transfers, and certified cheques. All payments are processed using secure, encrypted platforms.

5. Cancellation and Refund Policy

5.1 Customer Cancellations

  • More than 72 hours prior to departure: Full refund minus transaction fees
  • Between 24-72 hours before departure: Refund of 50%
  • Less than 24 hours before departure: No refund provided

5.2 Weather Cancellations

In case the captain deems weather conditions as unsafe, we will offer to either:

  • Reschedule the charter to another available date with no extra charge
  • Issue a full refund if rescheduling is not feasible

5.3 Mechanical Issues

If there is a mechanical problem with the assigned vessel, we will try to offer an appropriate alternative. If no alternative can be provided, a complete refund will be issued.

6. Safety and Conduct

6.1 Safety Requirements

All passengers are expected to:

  • Obey all directives from the crew
  • Utilize the safety gear as mandated
  • Inform us of any health issues that could impact their security
  • Stay within the designated areas of the yacht

6.2 Prohibited Items

The following are not allowed onboard:

  • Glass containers
  • Illegal substances
  • Firearms or weapons
  • Excessive beverages (above reasonable amounts)
  • Pets (unless with prior permission)

6.3 Conduct

Passengers must behave in a respectful way. Should passenger conduct pose a safety concern or disrupt others’ experiences, we may terminate the charter without a refund.

7. Liability and Insurance

7.1 Our Liability

We are only accountable for the cost of your charter. We are not responsible for:

  • Injuries sustained as a result of passenger carelessness
  • Loss or destruction of personal belongings
  • Indirect, incidental, or punitive damage claims
  • Delays originating from weather or situations outside our control

7.2 Insurance Coverage

Comprehensive marine insurance is upheld for our vessels and operations. Responsibility for personal travel and possessions insurance rests with the passengers.

7.3 Assumption of Risk

By deciding to participate in our charter services, you recognize that nautical activities inherently possess risks and you accept the responsibility for your safety and well-being.

8. Modifications and Itinerary Changes

We have the right to alter itineraries, paths, or schedules due to weather, safety, or operational demands. We will strive to provide alternatives of similar quality.

9. Force Majeure

We will not be liable for adjustments, postponements, or service changes stemming from events beyond our command, which includes but is not restricted to:

  • Extreme weather
  • Natural catastrophes
  • Mandates by authorities
  • Halt of ports
  • Mechanical failures

10. Privacy and Data Protection

Your private data is managed according to our Privacy Policy. You consent to the compilation and usage of your data as detailed within our Privacy Policy by utilizing our services.

11. Intellectual Property

The material on our website, which includes writing, images, trademarks, and logos, is protected by intellectual property rights. You may not duplicate, disseminate, or create work derived from it without our explicit consent.

12. Governing Law

Applicable laws of Germany govern these Terms. Any arising disputes will be addressed in the courts situated in Hamburg, Germany.

13. Changes to Terms

We own the discretion to adjust these Terms when necessary. Updated versions will be posted on the website with the revised date. Continuous utilization of our services implies acceptance of the new Terms.
